1. Introduction

Welcome to Truth and Tales! Truth and Tales is a platform of interactive narrative games, audiobooks, body movement activities, creative colouring activities, and music for children ages 4-8.

These Terms of Use ("Terms") govern the use of all services offered by Truth and Tales, including the mobile applications (iOS and Android), the web application at play.truthandtales.app, and the website at truthandtales.app (collectively, the "Service").

The Service is operated by ALL CRIAÇÃO DESENVOLVIMENTO E PRODUÇÃO DE INOVAÇÃO LTDA (CNPJ 31.461.388/0001-51), a company registered in Brazil, trading as "Truth and Tales" ("we", "us", or "our"). By accessing or using the Service, you accept and agree to these Terms. If you do not agree, please do not use the Service.

If you are using the Service on behalf of a school or other institution, you represent that you have the authority to bind that institution to these Terms. School use is additionally governed by a separate Data Processing Agreement and (where applicable) Pilot Agreement or Licensing Agreement.

2. Changes to these Terms

We may update these Terms from time to time, including the Privacy Policy. When we make material changes, we will update the "Last updated" date and notify registered users by email. For school accounts, we will provide at least 30 days' notice before material changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

3. Eligibility

Truth and Tales is designed for children ages 4-8 to explore freely. Children can create an account and use the platform independently. Purchases, subscription management, and access to external links require confirmation through a parental gate. By completing a purchase or managing account settings, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction).

4. Privacy

Personal information that identifies you as a user is subject to our Privacy Policy, and its terms are incorporated into these Terms. Please refer to the Privacy Policy to understand our practices regarding data collection, use, and protection.

5. Accounts

5.1 Family accounts (B2C).
You may create an account using Google Sign-In, Apple Sign-In, or email. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If your device is sold, lost, or stolen, deactivate your account or sign out of all devices. If you do not sign out, other users may access the Service through your account.

5.2 School accounts (B2B).
Schools receive login codes for students and educators through a separate licensing arrangement. The school is responsible for distributing and managing these codes. Student codes are anonymous and do not contain personal information.

5.3 Account termination.
You may delete your account at any time by contacting us at support@truthandtales.app. We will delete all associated data within 30 days. We may also terminate or restrict your use of the Service without compensation or prior notice if there is a suspicion of (i) violation of any of these Terms or (ii) involvement in unauthorised or inappropriate use of the Service.

6. Communication preferences

By using the Service, you consent to receive electronic communications from Truth and Tales relating to your account. These communications may include emails sent to the email address provided during sign-up, in-app notifications, and notices relating to your account (payment authorisations, password changes, confirmations, and other transactional information).

You may also receive other communications from Truth and Tales, such as newsletters about new content and features, if you have opted in to receive them. You can unsubscribe from non-transactional communications at any time by using the unsubscribe link in any email or by contacting support@truthandtales.app.

7. Free trial periods

Your use of Truth and Tales may start with a free trial period. The duration of the free trial may vary and will be specified at the time of activation. Free trial availability is subject to restrictions, and Truth and Tales reserves the right to determine eligibility. If your Apple or Google account has previously used a free trial for Truth and Tales, you may not be eligible for another trial (this is a constraint of the Apple App Store and Google Play Store platforms). At the end of the free trial, your subscription will begin automatically unless you cancel before the trial period ends.

8. Subscription, billing, and refunds

8.1 Free and paid content

Some content is available for free. Additional content requires a paid subscription.

8.2 Payment processing

All payments are processed through the Apple App Store or Google Play Store. We do not directly collect or store payment card information. The terms and conditions of the applicable app store govern your purchase.

8.3 Price changes

Truth and Tales reserves the right to adjust service prices at any time. Any price changes will be communicated to you by email before they take effect.

8.4 Subscription management

You can manage or cancel your subscription through your device's app store settings. Cancellation stops future charges but does not provide a refund for the current billing period, unless required by the app store's refund policy or applicable law.

8.5 Refunds (App Store)

Purchases made through the Apple App Store use Apple's payment system and are subject to Apple's Terms and Conditions. To request a refund for an App Store purchase, visit: https://reportaproblem.apple.com

8.6 Refunds (Google Play Store)

Purchases made through the Google Play Store use Google's payment system. You may cancel your purchase in accordance with applicable consumer protection law (including the Consumer Defence Code in Brazil). In such cases, the full price will be refunded directly to your payment method. For refund requests outside the statutory period, Truth and Tales will analyse the case individually. To request a refund, contact support@truthandtales.app with the email address associated with your account.

8.7 School licensing

School access is governed by a separate licensing agreement and is not subject to app store subscription terms.

9. Content and the Service

9.1 Content availability

You can access Truth and Tales content primarily in the country where you created your account and in geographical areas where we offer the Service and have licensed the content. Available content may vary by location, as not all content is translated into all languages simultaneously. We may add or remove content from one or more regions at any time.

9.2 Offline use

Some Truth and Tales content is available for download and offline use on compatible devices. To use content offline, you must first download it while connected to the internet.

9.3 Performance and compatibility

Content quality, loading time, and Service performance may vary depending on your location, available bandwidth, and the technical specifications of your device (memory, processing power, operating system version). Truth and Tales does not guarantee specific performance levels on any device, including continuous compatibility with your device. Content and features available may differ depending on your operating system and its version.

9.4 Updates

It is your responsibility to update the Truth and Tales application through the App Store or Google Play Store to access the latest content and features. Truth and Tales is not liable for issues arising from the use of outdated versions of the application.

10. Acceptable use

You agree to use the Service, including all its features and functionalities, in accordance with all applicable laws, regulations, and codes. You agree not to:

Use the Service for any unlawful purpose or for public showings.
Archive, download (except the cache necessary for personal use), reproduce, distribute, modify, display, publish, license, or create derivative works from the content without our express written authorisation.
Circumvent, remove, alter, deactivate, degrade, or tamper with any content protection in the Service.
Use any robot, spider, scraper, or other automated means to access the Service.
Reverse-engineer, decompile, or disassemble any software or other products accessible through the Service.
Insert any code or product, or manipulate the content of the Service in any way.
Use any method of data mining, data collection, or data extraction.
Upload, publish, or transmit any material designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment associated with the Service.
Reproduce, distribute, or alter the Truth and Tales trademark without prior authorisation.
Use the Service to collect personal information about other users.
Redistribute, sublicense, or resell access to the Service without our written permission.

11. Intellectual property

11.1 Copyright.
The Service, including all original content, stories, illustrations, narration, music, animations, game mechanics, interface, and software, is protected by copyright, trade secrets, and other intellectual property laws, and is the property of ALL CRIAÇÃO DESENVOLVIMENTO E PRODUÇÃO DE INOVAÇÃO LTDA and/or its commercial partners and licensors.

11.2 Trademarks.
"Truth and Tales" is a trademark of ALL CRIAÇÃO DESENVOLVIMENTO E PRODUÇÃO DE INOVAÇÃO LTDA.

11.3 Your licence.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Service for personal, non-commercial use (B2C) or for educational use within your licensed institution (B2B), subject to these Terms. You agree not to use the Service for public showings.

11.4 User-created content.
If the Service allows children to create content (such as drawings in Artist's Gallery), the child (or their parent/guardian) retains ownership of that content. We do not claim ownership of user-created content.

11.5 Copyright infringement.
If you believe that your work has been reproduced or distributed in a way that constitutes copyright infringement, or if you are aware of material that infringes copyright through the Service, please notify us at support@truthandtales.app

12. Feedback

Truth and Tales is free to use any comments, information, ideas, concepts, opinions, techniques, or other materials contained in any communication you send to us ("Feedback"), including responses to questionnaires through the Service, globally and in perpetuity, without remuneration, recognition, or payment to you, including for the development, improvement, and marketing of the Service.

You agree not to claim any "moral rights" to Feedback, to the extent permitted by applicable law. Truth and Tales does not accept unsolicited materials or ideas and is not responsible for any similarity between its content and materials or ideas transmitted to Truth and Tales.

13. Disclaimer of warranties

THE SERVICE AND ALL ASSOCIATED CONTENT AND SOFTWARE, AS WELL AS ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TRUTH AND TALES MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Truth and Tales is an educational platform, not a medical or therapeutic service. The platform does not diagnose, treat, or claim to cure any condition. Content is designed to support social-emotional development and should not be considered a substitute for professional advice.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TRUTH AND TALES, ITS SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, OR LICENSORS BE (JOINTLY OR SEVERALLY) LIABLE TO YOU FOR ANY GENERAL, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY NATURE.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF CERTAIN TYPES OF DAMAGES. CERTAIN LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law (including, for users in Brazil, the provisions of the Consumer Defence Code, Law 8.078/1990).

15. Indemnification

You agree to indemnify and hold harmless ALL CRIAÇÃO DESENVOLVIMENTO E PRODUÇÃO DE INOVAÇÃO LTDA, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

16. Governing law and disputes

16.1 Brazil.
If you reside in Brazil, these Terms are governed by the laws of the Federative Republic of Brazil. The courts of Florianópolis, Santa Catarina, shall have jurisdiction, except where consumer protection law requires the forum of the consumer's domicile.

16.2 United Kingdom.
If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015. Disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

16.3 Canada.

If you are a resident of Quebec, these Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. For other Canadian provinces, these Terms are governed by the laws of the province in which you reside and the applicable federal laws of Canada.

16.4 Other jurisdictions. You may also have the right to certain consumer protection rights under the legislation of your local jurisdiction, which applies in accordance with the jurisdiction from which you are making the purchase.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.
